Work out a property agent's commission from the sale price and agreed rate, add VAT if the agent is registered, deduct 3% withholding when the payer is a company, and split a share with a co-agent.

How it works

Commission = price × agreed rate. A VAT-registered agent adds 7% VAT on the commission. A company payer withholds 3% of the pre-VAT commission. Cash received = commission + VAT − tax withheld. The co-agent share is taken from the pre-VAT commission.

Example: a THB 3,000,000 condo at 3% commission is THB 90,000; VAT is THB 6,300, so the invoice is THB 96,300. A company payer withholds 3%, THB 2,700, and the agent receives THB 93,600. A 50% co-agent split gives each THB 45,000 before tax.

The commission rate is agreed between the parties; no law fixes it. Transfer fees and taxes on the property sale are excluded. Withheld tax is credited in the agent's return, and each party to a co-agent split has its own tax position.

Frequently asked questions

Must commission be 3%?

No law requires 3%; it is simply common in the market. Sellers and agents agree the rate and terms in their contract.

Who must withhold tax?

A company payer withholds 3% on commission and issues a certificate to the agent. For an individual payer this tool does not deduct anything; check that case's withholding duty with the Revenue Department.

What is VAT charged on?

If the agent is VAT-registered, 7% VAT is on the commission, not the property price. Withholding is on the pre-VAT commission.
