Work out the extra personal income tax from 40(5) rental income, with the flat expense rate for each asset type, other income and allowances, less the 5% withheld by a company tenant.

How it works

Under Royal Decree No. 11, section 5, an owner renting out property deducts a flat rate by type: houses, buildings, structures or rafts 30%, agricultural land 20%, other land 15%, vehicles 30% and other property 10%. Net rent is added to other income after expenses, allowances are deducted and progressive rates applied. The rent's tax is the difference with and without the rent. Any 5% withheld by a company tenant is credited when you file.

Example: a condo let at THB 15,000 a month earns THB 180,000; after the 30% flat deduction THB 126,000 remains. With THB 400,000 of other income after expenses and THB 100,000 allowances, taxable income rises from THB 300,000 to THB 426,000 and tax from THB 7,500 to THB 20,100, so the rent adds THB 12,600. If a company tenant withheld 5% (THB 9,000), THB 3,600 more is due.

For owners letting their own property with flat expenses only; subletting and actual-expense claims are excluded. Rent received January–June also requires the half-year PND 94 return. The 0.5% minimum tax under section 48(2), land and building tax and spouse cases are not modelled.

Frequently asked questions

What flat expense applies to a condo?

A condo is a building, so an owner-lessor deducts a 30% flat expense, or actual expenses if proven to be higher.

Must I file a half-year return?

40(5) income received January–June must be filed on PND 94 by September with half the allowances; tax paid is credited in the annual return.

Is 5% withheld the final tax?

No. Include the rent in your return and credit the withholding; you may pay more or get a refund depending on your bracket.
