How it works
Under Revenue Code Amendment Act No. 40 (2015), support or gifts from an ascendant, descendant or spouse are exempt up to THB 20 million per tax year; gifts from others by moral duty or custom up to THB 10 million; and parents' gratuitous transfers of real estate to legitimate children up to THB 20 million per tax year. The excess may be taxed at 5%. The tool counts earlier gifts in the year first, then taxes only the excess created by this gift.
Example: a father gives his child THB 25 million in one year; the THB 5 million above THB 20 million is taxed at 5%, THB 250,000. If THB 15 million came earlier and THB 10 million now, this gift creates a THB 5 million excess, THB 250,000. A customary gift of THB 12 million from a relative exceeds THB 10 million by THB 2 million, THB 100,000.
For individuals in the listed cases only. Specific business tax, land transfer fees and stamp duty on real estate transfers are excluded. Adopted children are outside the real estate exemption for transfers to children. Gifts for religious, educational or public purposes have their own conditions; check with the Revenue Department for complex facts.
